1. Informații Generale
Prezenta Politică de Confidențialitate explică modul în care Seaside Branding (operat legal prin Emil-Marc Paraschiv PFA, denumit în continuare „Operatorul” sau „Compania”), colectează, utilizează, stochează și protejează datele cu caracter personal ale utilizatorilor site-ului seasidebranding.com, ai platformelor conexe de ticketing și ale participanților la evenimentele organizate (inclusiv Zoom In Film Festival).

2. Datele Colectate
Colectăm următoarele categorii de date:
Date de identificare și contact: Nume, prenume, adresă de e-mail, număr de telefon.
Date financiare și de facturare: Adresă de facturare, detalii de plată (procesate securizat prin furnizori terți autorizați) necesare emiterii documentelor fiscale legale.
Date privind proiectele/înscrierile: Informații despre filmele înscrise și membrii echipei adăugați.
Date tehnice și Cookie-uri: Adresă IP, tip de browser, date de geolocalizare, module cookie și comportament de navigare.
Materiale vizuale: Imagini foto și înregistrări video realizate în cadrul evenimentelor noastre.

3. Scopurile și Temeiurile Juridice ale Prelucrării
Prelucrăm datele dumneavoastră în următoarele scopuri:
Executarea contractului: Pentru emiterea biletelor, validarea înscrierilor la festival și furnizarea serviciilor solicitate.
Obligații legale: Pentru respectarea legislației fiscale, contabile și de arhivare aplicabile conform legii.
Interes legitim și Marketing: Pentru securitatea platformei, optimizarea serviciilor și promovarea evenimentelor noastre.

4. Politica de Cookie-uri și Tehnologii de Urmărire
Site-ul utilizează module cookie (esențiale, analitice și de marketing) pentru a îmbunătăți experiența de navigare și pentru analiza traficului. Utilizatorii își pot gestiona sau opri preferințele de cookie-uri în orice moment prin intermediul bannerului dedicat sau din setările browserului.

5. Drepturile de Imagine, Foto/Video și Social Media
Acordul privind prelucrarea imaginii: Prin prezența la evenimentele organizate de Seaside Branding (ex. ZIFF) sau prin achiziționarea unui bilet/înscriere, participantul ia la cunoștință și își dă acordul expres ca imaginea, vocea și reprezentarea sa fizică să fie captate prin fotografie sau înregistrare video.
Utilizarea materialelor: Seaside Branding își rezervă dreptul neexclusiv, gratuit și nelimitat în timp și spațiu de a utiliza aceste materiale foto/video în scopuri promoționale, de PR, de arhivă și de marketing, pe platforme Social Media (Facebook, Instagram, LinkedIn, TikTok, YouTube etc.), pe site-urile proprii și în materiale de presă.
Renunțarea la pretenții financiare: Participanții renunță la orice pretenție financiară sau drept de autor cu privire la utilizarea materialelor foto/video realizate în cadrul evenimentelor.

6. Protecția Datelor Minorilor
Participarea la festival și achiziția de bilete sunt destinate persoanelor de peste 18 ani (sau 16 ani, după caz). În cazul în care la eveniment sau în filmele înscrise apar minori, părintele sau tutorele legal își exprimă consimțământul implicit sau explicit pentru prelucrarea imaginii minorului prin participarea la eveniment sau trimiterea materialului.

7. Perioada de Retenție a Datelor
Păstrăm datele cu caracter personal doar atât timp cât este necesar:
Date fiscale/contabile: 10 ani, conform cerințelor legale din România.
Date de biletare și înscriere: Pe durata desfășurării evenimentului și până la 3 ani după finalizarea acestuia (termenul general de prescripție).
Date de marketing/newsletter: Până la retragerea consimțământului (dezabonare).
Materiale foto/video: Pe durata existenței proiectelor de arhivă și promovare ale Seaside Branding.

8. Partajarea Datelor și Transferul Internațional
Datele pot fi transmise către terți parteneri (procesatori de plăți, platforme de ticketing precum pretix, servicii de e-mail marketing, contabilitate). În cazul în care datele sunt transferate în afara Spațiului Economic European (SEE) (de exemplu, către platforme precum Meta, Google, Mailchimp), ne asigurăm că transferul se bazează pe Clauze Contractuale Standard (SCC) aprobate de Comisia Europeană sau pe cadre de confidențialitate recunoscute.

9. Securitatea Datelor, Breșe de Securitate și Limitarea Răspunderii
Aplicăm măsuri tehnice adecvate pentru protecția datelor. În cazul improbabil al unui incident de securitate major (Data Breach), vom notifica ANSPDCP și persoanele afectate în termen de maximum 72 de ore, conform GDPR.
Seaside Branding nu poate fi trasă la răspundere pentru atacuri cibernetice neprevăzute ce depășesc standardele industriale de securitate și nici pentru modul în care platformele terțe de Social Media prelucrează datele publicate.

10. Drepturile Dumneavoastră (GDPR)
Conform Regulamentului UE 2016/679, aveți următoarele drepturi:
Dreptul de acces, rectificare sau ștergere a datelor („dreptul de a fi uitat”).
Dreptul la restricționarea prelucrării, portabilitatea datelor și opoziție.
Dreptul de a vă retrage consimțământul în orice moment.

Throughout this document, we will refer to the company using the terms “Company”, “We”, or “Seaside Branding”, while any natural or legal person accessing the site, purchasing tickets, or submitting works will be referred to as the “User” or “Client”.

2. Scope of Activity and Acceptance of Terms
Seaside Branding provides branding, production, marketing, and cultural event/festival organization services. The information presented on the website is for informational and commercial purposes.
Browsing the website, completing forms, submitting to festivals, or purchasing tickets implies explicit and unconditional acceptance of these Terms and Conditions. If you do not agree with the provisions of this document, please do not use our website and services.

3. Intellectual Property
The entire content of the website (texts, logos, graphics, design, concepts, audio-video elements) is the exclusive intellectual property of Seaside Branding or its partners and is protected by copyright and related rights legislation (Law no. 8/1996).
Copying, reproducing, distributing, modifying, or republishing any content without the prior written consent of the Company is strictly prohibited.

4. Ticketing and Event Services (e.g., ZIFF)
4.1. Purchase of Tickets and Submissions
The sale of access tickets and the processing of film competition submission fees are carried out through our secure integrations (e.g., pretix). The distance contract is considered concluded upon receipt by the Client of the order and payment confirmation email.
4.2. Refund Policy and Right of Withdrawal
In accordance with Emergency Ordinance (OUG) no. 34/2014 (Art. 16 lit. l), leisure services providing a specific date or performance period (including tickets to festivals, shows, or competition submission fees for a fixed date) are exempt from the right of withdrawal. Therefore, purchased tickets and paid submission fees are non-refundable, and cancellation for personal reasons does not entitle the buyer to a refund.
4.3. Cancellation, Postponement, or Modification of the Event
Cancellation: If an event is permanently canceled due to the Organizer’s fault, the face value of the tickets will be fully refunded to buyers within [e.g., 14 business days].
Postponement / Rescheduling: If the date or location is changed for reasons beyond our control, tickets remain valid for the new date. Buyers will be notified via email and will have the option to request a refund within the deadline specified in the official notice.
4.4. Copyright for Submitted Works (e.g., Film Festivals)
Participants submitting materials, short films, or movies to competitions organized by Seaside Branding declare and warrant under their own responsibility that they own all copyrights and necessary licenses for the submitted works (including rights to music, imagery, and script). Seaside Branding bears no responsibility for any copyright infringements by participants, with the latter assuming full legal and financial liability in the event of a dispute with third parties.

5. Liability and Limitations
Website Operation: Seaside Branding makes every effort to ensure uninterrupted and secure operation of the website, but does not guarantee the absence of temporary technical errors or disruptions caused by internet service or web hosting providers.
Limitation of Liability: The Company accepts no liability for indirect damages, secondary financial losses, or inconveniences caused by the temporary inability to access the website.
Force Majeure: Neither party shall be held liable for non-performance of contractual obligations if caused by a force majeure event (such as natural disasters, legal restrictions, states of emergency, pandemics, or major infrastructure failures) as defined by Romanian law.

6. Personal Data Protection (GDPR)
The processing of your personal data (name, email, payment details, etc.) is carried out in accordance with Regulation (EU) 2016/679 (GDPR).
We collect only the data necessary for issuing tickets, billing, providing services, and sending communications related to the event. 7. Applicable Law, Complaints, and Dispute Resolution
This agreement is governed by and interpreted in accordance with Romanian law.

If you are a consumer (natural person) and the dispute cannot be resolved amicably, you have the right to address the competent authorities or use alternative dispute resolution channels:

If the dispute cannot be resolved amicably or through ADR/ODR procedures, it shall be submitted for resolution to the competent courts at the Company’s registered address.

Seaside Branding reserves the right to update or modify this document at any time without prior individual notice. The applicable version is the one published on the website at the time of making the transaction or using the site. We recommend checking this page periodically.
